I know. The cop twitched with his finger inside the trigger guard… I was a state trooper for 5 years. The cop was poorly trained, scared and stupid. He violated rule #1 of handling any firearm: Never put your finger on the trigger until you are going to fire… Never!!…  FR

‘Hands up, don’t shoot’ legitimized

A Florida man is in disbelief after North Miami police shot him while he lied on the pavement with both hands in the air.

Caregiver Charles Kinsey, 47, was outdoors with an autistic patient Monday when two police officers showed up responding to reports of an armed, suicidal man.

Footage released Wednesday shows Kinsey on the ground, hands raised and attempting to explain to officers the item they perceived to be a weapon was in actuality a toy truck.

“All he has is a toy truck. A toy truck. I’m a behavior therapist at a group home,” Kinsey tells officers, who at that point had guns drawn.

“I’m going to the ground, just like this with my hands up. And I’m laying down here just like this. And I’m telling him again, ‘Sir, there’s no need for firearms. I’m unarmed, this is an autistic guy. He has a toy truck in his hand.’”

Despite his efforts, one officer fired off a round which struck Kinsey in the leg.

Kinsey says officers at that point did not administer medical treatment, but instead handcuffed him – with three sets of handcuffs – at the scene.

“They flipped me over, and I’m faced down in the ground, with cuffs on, waiting on the rescue squad to come,” Kinsey told WSVN. “I’d say about 20, about 20 minutes it took the rescue squad to get there. And I was like, bleeding — I mean bleeding, and I was like, ‘Wow.’ ”

He also got an opportunity to ask the officer why he shot him.

“When he shot me, it was so surprising. It was like a mosquito bite. And when he hit me, I’m like, I still got my hands in the air. I said, ‘You know, I just got shot.’ And I’m saying to them, ‘Sir, why did you shoot me?’ And his words to me, he said, ‘I don’t know.’”

The North Miami Police Department has placed the officer involved on administrative leave and the Florida state attorney is also looking into the case.

  2. Why inexperienced/bad cops make it dangerous for the rest of law enforcement. Amazing! You fools keep giving BLM fodder to keep demonstrating and rioting. I’m so glad Mr. Kinsey is going to be okay. The officer should be charged and go to jail. The caller who stated a man had a gun and was going to commit suicide is at fault for conveying false information. The police have to use discernment when they get citizen information and did not listen to what Mr. Kinsey had to say nor observe the actions of the autistic man long enough to correctly assess the situation. I hope Mr. Kinsey sues for enough to make him comfortable for the rest of his life. Then he can volunteer at the group home instead of being an employee. You can tell Mr. Kinsey has a kind heart by the way he was speaking to his autistic client, trying to keep him safe even though Mr. Kinsey had already been shot.

  4. I can envision what happened as if I were standing there. He had his AR-15 semi-automatic .223cal rifle (NOT ASSAULT WEAPON) angled toward the ground. So far, SOP. But he had his finger ON THE TRIGGER and the safety was OFF. Under stress after a long day on the firing range when I was a rookie at the academy I had the same thing happen to me.

    We were all hot and to tired. We were supposed to be. We were locked, loaded and the range was hot. On command I came to the ready and aimed downrange I flipped the safety to FIRE and put my finger inside the trigger guard and -BOOM-… I didn’t squeeze the trigger, I twitched!… I didn’t tell the range master and kept firing but I think he knew. He glared at me but at least he didn’t yell at me or gig me. It spoiled my score because the shot went wild. It may have hit anywhere down-range. I never knew but I learned one of the most valuable lessons a cop can learn that day and any cop who breaks that cardinal rule of firearm safety has no business with a badge, much less a firearm.

    Mr. Kinsey was very fortunate. So was the autistic man he was caring for. Either one or both could have been killed or crippled for life that day from that one round. I have zero respect for any of the other cop’s actions on the scene that day. I have not been able to ascertain the outcome of the AG’s “investigation” but I can guess. And you can too. This is no better than BLM or the Panthers. And so far as I know the shooter’s name is still “Anonymous” and will stay that way. These situations are all Obozo and Hitlery and the gun-grabbers live for.
